            Dear Mr. Hageman;

             Thank you for all of the valuable responses you have posted on these forums. I have learned a great deal from them. The Interstate Compact system can be very confusing. I was transferred from MN to CO two years ago on a “Stay of Adjudication” sentence for “Receiving Stolen Property” and because of the dollar amount involved it was at a felony level. With that came ten years of probation, and a whole lot of legal problems. I have been fighting “Verifications Inc.” one of the largest background investigations companies for designating me as a convicted felon even though a Stay of Adjudication means no conviction has been entered into the court. A result of which is a significant impact on my career in Information Technology. I lost an opportunity for a permanent position with a large financial company and have lost a relationship with a contracting firm which has marketed me within the IT industry.

 My question to you is in May of this year my PO in Colorado submitted a Progress Report requesting that I receive early termination of my probation due to my exemplary behavior and continued volunteer and community involvement. This is of course a “God send” because it would mean that my Stay of Adjudication would be fulfilled and I could go back to living as a non-convicted felon. What is the process for pursuing the prospect of getting released from my probation? I talked to my PO in MN and in CO with no clear answers. Specifically, how do I get released from probation when I am in the ICAOS system?

Thank you for the kind words. The Commission is proud of its website and I am pleased you find it helpful.

The Interstate Commission for Adult Offender Supervision does not play a role in the process for early terminations from supervision. A supervising officer in the receiving state can make a recommendation for early termination from supervision, however the decision is up to the probation officials and the local court in the sending state.

I don't know the specifics of your program, therefore I don't know if an early termination is possible. I suggest that you contact a MN attorney and determine if it is possible to petition the court for an early termination.
